Welcome to AIToTest. These Terms of Service ("Terms") govern your access to and use of AIToTest's website, products, and services ("Services"). AIToTest Inc. is a company registered in Delaware with its principal place of business at 535 Mission Street, San Francisco, CA 94105 ("AIToTest," "we," "our," or "us").
By using our Services, you agree to be bound by these Terms. If you are using our Services on behalf of an organization, you are agreeing to these Terms on behalf of that organization and represent that you have the authority to do so.
2. Service Description

AIToTest provides an AI-powered testing platform that includes:
- Automated test generation and execution
- Code coverage analysis and reporting
- Integration with CI/CD pipelines
- Performance testing and optimization
- Security vulnerability scanning
- API testing and documentation
2.2 Enterprise Features
Enterprise customers receive additional features including:
- Custom AI model training
- Dedicated support and consulting
- Advanced security controls
- Custom integrations
- Service level agreements (SLAs)
3. User Accounts and Registration
3.1 Account Creation
To access our Services, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
3.2 Account Types

6. Service Level Agreement
6.1 Availability
We strive to maintain 99.9% uptime for our Services. However, we may occasionally need to perform maintenance or updates that could affect service availability. We will provide advance notice of scheduled maintenance whenever possible.
6.2 Support
Support response times vary by account type:
- Enterprise: 1-hour response time, 24/7 support
- Team: 4-hour response time, business hours
- Developer: 24-hour response time, business hours
7. Fees and Payment
7.1 Pricing
Our pricing is based on:
- Number of users
- Usage volume
- Selected features
- Support level
7.2 Payment Terms
Payment terms include:
- Monthly or annual billing options
- Auto-renewal by default
- Net-30 terms for enterprise customers
- Multiple payment methods accepted
8. Termination
We may suspend or terminate your access to the Services:
- For violation of these Terms
- Non-payment of fees
- Fraudulent or illegal activity
- Upon your request
Upon termination:
- You must cease all use of the Services
- Outstanding fees become immediately due
- You may export your data within 30 days
- We will securely delete your data after 90 days
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Services are provided "as is" without warranties
- We are not liable for indirect or consequential damages
- Our total liability is limited to fees paid in the last 12 months
- We do not guarantee specific results or outcomes
10. Changes to Terms
We may modify these Terms from time to time. We will notify you of material changes by:
- Email notification
- In-product notifications
- Website announcements
Continued use of the Services after changes constitutes acceptance of the modified Terms.
11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
12. Dispute Resolution
Before pursuing legal action, parties agree to:
- Engage in good faith negotiations
- Participate in mediation if negotiations fail
- Submit to binding arbitration as a last resort
Arbitration will be conducted by JAMS in San Francisco, California. Each party will bear its own costs unless otherwise determined by the arbitrator. Class action lawsuits, class-wide arbitrations, private attorney-general actions are not permitted.
13. Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to:
- Natural disasters or acts of God
- War, terrorism, or civil unrest
- Government actions or regulations
- Network or telecommunications failures
- Power outages or infrastructure failures
- Cybersecurity incidents by third parties
The affected party shall promptly notify the other party and resume performance as soon as reasonably possible.
14. Assignment
You may not assign or transfer these Terms or your rights and obligations without our prior written consent. We may assign our rights and obligations under these Terms to any:
- Affiliate or subsidiary
- Acquirer of our business or assets
- Successor by merger or reorganization
Any attempted assignment in violation of this section shall be void.
15. Indemnification
You agree to indemnify, defend, and hold harmless AIToTest and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of applicable laws or regulations
- Your User Content or submissions
- Your interaction with other users
- Unauthorized use of your account
16. Severability
If any provision of these Terms is found to be unenforceable or invalid:
- That provision shall be limited or eliminated to the minimum extent necessary
- The remaining provisions shall remain in full force and effect
- The unenforceable provision shall be replaced with an enforceable provision that comes closest to the intention of the original provision
